the woman who claims her mother's boyfriend kidnapped her when she was 15 and held her captive said she felt alone and helpless thump suspect's lawyer says she is lying. the woman says this man drugged her when he took her, raped her, forced her to marry him and forced her to have his child. prosecutors say he convinced her nobody was looking for her. now the woman, age 25, says she knows that is not true. >> it was afraid about everything because i was alone. i wasn't -- my family was with me. >> the man's attorney says there was no kidnapping and that the two were breaking up.

he says the woman is trying to get back at his client. >> he treated her like a queen. he was devoted to her. he did what she wanted. she was happy. she had her own car, her own job. he never hit her. nobody ever saw him hit her. nobody ever told her she has to go somewhere or has to do something. >> if convicted the suspect faces up to 19 years in prison. let's bring it to a lawyer, dan shore is a former prosecutor and with us now. it was also more than a year ago we saw the aerial castro situation in ohio. that was pretty voice, shackled to the walls. this one not so clear. >> the three women involved in that case were physically restrained for a decade. here she had freedom of movement, able to talk to people, able to have a facebook page and have polite, however she went with this individual when she was 15 so she was under the age of consent. she says she was drugged and woke up in a garage.

even if she swept willingly she was still underage so there's serious crimes from that. >> his lawyer says the guy comes from a different culture. there are different norms in other countries outside the united states. >> actually had cases like that as a sex crimes prosecutors, where defendants had sex with underaged girl and said, it's acceptable in my country. but century -- under american law there is an age of consent. >> everybody acknowledged he worked a couple of jobs, gave her fair amount of -- even she said he gave me whatever i needed, bought her a new minivan. if he is buying her minivans and she has access to the speier net how can it be captivity? >> there's a lot of questions why she didn't get help. the criminal charms all relate to 2004 when she was first taken when she was underage. they have not filed charges for the

later period, the recent period, maybe because it's hard to prove because she had access to the outside world. but still had the actions when she was 15 to 18 where she was underaged and that's what the charges are based on. >> we'll continue to watch the case. breaking news, judge has ruled than a convicted serial rapist must be released to live in los angeles county community. christopher edwards hubbard admitted to raping women between the 19 1 and 1982. investigators say the numberer is actually closer to 100 women. folks in the the community have protested his release. so the question is, where will he go let's go back to dan shore, former prosecutor who worked sex crime cases. this guy had served his time, and was being held in a mental facility? >> right. he was released from prison in 1996. his crimes were with multiple women, ending in 1982, then he

was incarcerated in a psychiatric facility, not a prison and is going to be released into a communit y. it's difficult when you have a serial rapist, served their time in prison. where do they live? you still worry about him being a threat to the community. >> he has to wear the gps bracelet that monitors his whereabouts. are you satisfied with that kind of thing? >> it's comforting he will be watched but it's still disconcerting that someone who is violent convicted rainess will be in -- rapess in the community. a local assemblyman was trying to spread the word about the fact he is moving there. so people are aware, but it's never totally assuring that someone with a violent past is going to be in the unit. >> can also be a problem for the suspect, for the newly released himself. his face is very public and a lot of people are out there who don't want that kind of person

secretary of state john kerry says he will testify on capital hill about the attack on the u.s. outpost in benghazi but only once. he is responding to a subpoena. state department official says if secretary kerry testifies before that panel next month he should not have to appear before the new select committee that house republicans created. no response from the select committee. the attack in benghazi on september 11, 2012, killed four americans, including the u.s. ambassador to libya. defense secretary chuck hagel says it's too soon to ask general walker shinseki to resign as head of the veterans

charge, and he talked about fix the problem. there's more and more talk about that. it's interest that republican senator mccain and house leader nancy pelosi are talking about the idea of vouchers. you believe these alwayses and there are thousands of millions of veterans out there who need to see a doctor and are unable to see a doctor because of long wait times, why not give them voucher to good to a private doctor or private medical facility right away. that would really be fixing the problem. it's not permanent fix but at least would get the people who are maybe in harm's way because of their enable to see a doctor, an opportunity to see one, and the government would have to pick up the tab. >> it does seem the drum beat against shinseki is getting somewhat louder. michelle nunn, the senate candidate in georgia, the daughter of sam nunn, longtime expert on mill tar affairs in

the senate, she is saying the department need news leadership, not necessarily saying he should be fired but perhaps inviting his resignation. he has fewer and fewer supports these days, it seems. >> well, absolutely. let's face it, a lot of that is politics in the sense that michelle nunn is in the middle of a tough race, democrat running for the senate in georgia. she is calling for shinseki to be replaced. allison lundergan grimes, another democrat run are foe the senate against mitch mcconnell in kentucky, she is calling for shinseki to resign. if youer a democrat and you're worried you'll get tarred with this brush that may hit the president and a lot of democrats about the incompetence or inefficiency of government under this democratic president, it's a kind of safe place to be. a baseball team in trouble, fire the manager, quick fix, doesn't necessarily get the team higher up in the standings, however. so that may be more politics

the feds say they are investigating yet another close call between two jets. the third near collision they have reported in recent weeks. this happened at houston's airport. official says air traffic controllers cleared a united airlines jet to take off for mexico city as controllers also directed another united airlines jet to turn on to the runway into the path of the first aircraft. officials say the planes came within less thon a mile of each about but separated vertically by 400 feet. another close call at new newark airport and a near collision of two planes over the pacific ocean. >> this is a live map of the air traffic over the u.s. right now and air traffic controllers have their hands full and to put these distances in perspective, takes one of these jets seven seconds to fly one mile. so take two planes at cruising

deep they're considering what they call catcher's mit strategy. they try to push the flames out of the canyons, to into more open area. it burns more acreage but makes it easier for the firefighters to fight. the winds are still a big concern. >> still on the edge, as i just finished explaining. those winds could change -- we get an ember across the line we're back to where we were 36 hours ago. >> the fire burning about 7.5 squirrel miles so far inching close to 3,200 homes in the area. john? >> so are they predicting this weekend will be a bust? >> pretty much a best. even if the thunderstorm came through and dropped a decent amount of rain, you're still talking about that oak creek resort area. oak creek resort, pretty much being shut down for the entire weekend. that's one of the premiere destinations in arizona, especially on memorial day. this area gets 4 million

they had two marine aattack helicopters to come in making a strafing run and then brought in two transport helicopters loaded with marines and the marines did a ground tactical demonstration. yesterday i went on a similar flight. take a look. >> this is loaded with marines. and headed toward a unique target. >> as marine we like to plan in detail. as aviator we like to plan in to tail. >> in this case the mission ended in a baseball field on long island. after the sea stallion swoops in, an osprey follows and the students capture every moment. >> i was just like amazed. you see these things on video, video games, but to actually have one land on your baseball field is mind-blowing. >> gets even better as the marines put on a show.

an american veteran of the war in afghanistan says it took him almost a year to re-unite with the service dog who stood by his side in the combat zone. an estimated 3,000 dogs are on active duty. this dog is named zenith who worked with the marine corporal in afghanistan. doctors amputated both of the corporal's legs after a bomb blast in 2011 but he says zenith never left his side. he calls him his quiet partner. joining me now, retired marine dog handler, corporal jose armenta and his dog venus.

thank you for coming here you were injured grievously in afghanistan. zenith was with you at the time. >> that's correct, he was. on ag situation? he was working, you had found some ieds in the ground and then one got away. >> that's correct. we were searching for explosives, i.e.and we didn't find one and that's the one i stepped on. >> a lot of people think there's a program in the military to keep military dogs united with their handlers, especially after the handlers leave the service. that doesn't -- isn't the case? >> no. as far as i know, as of now there's no official program that exists for that purpose. >> just gave you a kiss there. >> he did.

>> after you got hurt, you said that zenith was right with you all throughout that day you were injured and beyond? >> yeah. he was 20 feet in front of me when i stepped on the ied, and after that he was by my side while washington was receiving medical attention. >> how did you get him back to this country and get re-united with him? >> well, he was redeployed after i was injured with another dog handler. they finished his deployment in afghanistan. after they returned from the deployment, i put in the necessary paperwork and request for him, and then after it was just a long waiting period, bat year. >> and he finally got to retire and take it a little easier with you? >> yep. that's right. now he is living the retired life. steaks and living on the couch. >> he's doing well. how howe are you doing? >> i'm doing well. i can't complain. i got a loving family and i got my dog with me, so i'm happy.
